I was an avid reader when I was young, but drifted toward the sciences in high school after developing an interest in math and geometry in particular. I dreamt of going to the U.S. to become an astrophysicist. But my father insisted that I go to law school and I ended up changing course. I studied law and eventually became a judge, but there were times when I went astray believing that this profession was not for me.
 
I developed a passion for law when I went to Harvard as a judge to study the U.S. constitution, contract law and criminal law. I thought that the practice of law was primarily rhetorical. I felt there was no concrete standard. I strongly believed that, although the law exists, it was abstract and led different justices, prosecutors and attorneys to arrive at varying interpretations to suit their individual tastes, while who you knew mattered most. As a result, there were times when I wondered why I had dedicated my life to such a subjective profession and resented my father.
 
But my I saw an entirely new world as I studied law in the U.S. by analyzing legal precedents and observing how Americans applied facts and the law as if they were accurately putting together pieces of a puzzle. I realized that the law was not a game of words, but a science that was closer to axioms and theorems in Geometry. That was when I became a constitutionalist.
 
If everyone abides by the constitution, there is order and stability in our lives, which leads to a stronger and more prosperous nation and a growing confidence in the possibility of achieving individual happiness. I realized that the reason Koreans were unhappy in spite of their material wealth was due to a failure of justice and equality functioning properly in society.
 
I ran for the presidency of the Korean Bar Association because of my desire to contribute to the realization of the rule of law in my country as a judicial officer. And I believe I gave it my best shot during my two-year term. It was after my term ended as the president of the Korean Bar Association that I headed to the U.S. to study the American constitution, evidentiary law and the code of legal procedure. As I pursued my studies, my belief in the rule of law grew even stronger. I thanked my father for steering me in the direction of the legal profession.
 
 It was during this time that the Choi Soon-sil scandal broke out and I realized that I could not sit idly by as politicians, journalists, legal experts and the entire Korean public headed in the opposite direction of the rule of law. I strongly felt that my country was walking down the path of the Cultural Revolution in China from the mid-1960s to 1970s when millions of people were persecuted in the violent struggles that ensued across the country carried out in the name of preserving 'true' Communist ideology in the country by purging remnants of capitalist and traditional elements from Chinese society.
 
I felt that a member of the legal profession like myself could not afford to stay silent at a time like this and began to put my thoughts down on paper. But not a single Korean news agency bothered to publish my writing. Fortunately, Chogabjae.com began publishing my pieces and I began writing with a passion that reminded me of what our ancestors must have felt during the independence movement against Japanese colonial occupiers during the early 20th century. And this book is a compilation of my writings.
 
I sincerely hope that many people would be able to read this book and realize that the National Assembly’s impeachment proceeding against President Park Geun-hye is not only unlawful, but unconstitutional as well and that we must all strongly protest against the Constitutional Court, National Assembly and the news media so that the president can complete her five-year term as promised and ensure that constitutional rule can be restored so that our nation can return to being governed by the rule of law.
 
I would like to dedicate my first-ever book to my wife, Han Yeon-geum, who has always been by my side. And I would like to extend my gratitude to my friends, Dr. Chung Gwi-young, artist Yeom In-seok, my co-worker Cha Hak-sung and senior Chung Hak-cheol, who edited my work and supported my efforts, as well as my protege Park Do-soo, who helped me search for materials. I am also extremely grateful to Cho Gab-jae, who gave me the idea to write this book and oversaw its publication. Let me also extend my best wishes to my fellow countrymen who hit the streets braving the cold to oppose the impeachment of President Park Geun-hye.
 
In closing, I would like to express my endearment and respect for President Park, who continues to steadfastly uphold our Constitution without losing her stature as our nation’s leader, in spite of the trials and tribulations she suffered for having the wrong friend and facing impeachment.

나는 어릴 적에 책 읽기도 좋아했지만 수학 특히 기하학을 무척 좋아해서 고등학교 때는 理科(이과) 반이었고 장차 미국 가서 우주물리학자가 되는 꿈을 가졌다. 그런데, 고등학교 졸업 무렵 아버님께서 강력하게 법대를 권하셔서 법대에 입학하고 사법시험에 합격하여 판사까지 되었으나 별로 적성에 맞지 않는 것 같아 한때는 방황을 하였다.

내가 법학에 열정을 갖게 된 것은 판사시절 미국 하버드법대에 유학을 가서 미국헌법, 계약법, 형사법 등을 배우면서부터이다. 한국에서는 법률이 적당히 말장난하는 것처럼만 느껴졌었다. 아무런 확실한 기준이 없다고 느꼈다. 법률이라는 것은 있지만 추상적이어서 판사마다, 검사마다, 변호사마다 제각기 자기 입장에서 적당히 법조문을 해석해서 우겨 보다가 다수나 강자, 윗사람이 편들면 이기는 거고 아니면 지는 것이라는 생각이 강했다. 그래서, 어떤 때는 내가 왜 이런 과학적 근거도 없는 말장난에 인생을 다 바치나 하는 생각이 들어 나에게 법대를 권하신 아버님이 원망스러울 때도 있었다.

그런데, 미국법을 공부하면서부터 판례라는 것을 가지고 사실과 법을 마치 퍼즐 맞추듯이 정확히 맞추어나가는 미국인들의 법률운영을 보면서 눈이 떠졌다. 아, 법률은 이론이나 말싸움이 아니구나. 기하학의 公理(공리), 定理(정리), 도형 맞추기와 같은 과학이구나 하는 것을 깨달았다. 그때부터 나는 법치주의자가 되었다.

사람들이 법치주의를 가지고 살면 모든 생활에 질서와 안정이 오고, 그러다 보면 나라가 부강해지고 개인에게도 행복이 온다는 것을 확신하게 되었다. 한국 사람들이 경제적으로는 부유하면서도 행복하게 살지 못하는 것도 사회에 公正(공정), 즉 공평과 정의의 법치가 제대로 되지 않아서라는 것을 깨달았다.

대한변호사협회장 선거에 나간 것도 법조인으로서 이 나라에 법치주의를 실현하는 데 기여를 하고 싶어서였다. 2년 동안 내 나름대로는 열심히 일했다. 임기를 무사히 마친 후 개인적인 사정으로 미국에 와서부터 본격적으로 미국의 헌법, 증거법, 소송법 등을 다시 공부하면서 법치주의에 대한 나의 신념은 더욱 굳어졌다. 나에게 법대를 권하신 아버님께 감사드렸다.

그러던 차에 최순실 사건이 터지면서 우리나라의 정치, 언론, 법조, 국민이 모두 법치주의와는 정반대의 방향으로 마구 치달려 나가는 것을 보고 이대로 가다가는 우리나라가 자칫하면 중국의 文化革命(문화혁명) 때와 같은 혼란의 10년을 겪을 것이라는 생각이 들었다.

평생을 법조인으로 살아온 내가 이럴 때 침묵하면 안된다는 생각이 들어 글을 쓰기 시작했다. 그러나, 대한민국의 어느 언론도 나의 글을 실어주지 않았다. 다행히, 조갑제닷컴에서 글을 실어주기 시작하여 나는 마치 우리 선조들이 日帝(일제) 때 독립운동한 심정으로 매일같이 글을 썼다. 이 글들을 모은 것이 바로 이 책이다.

이 책을 읽고 많은 국민들이 朴槿惠(박근혜) 대통령에 대한 우리 국회의 탄핵이 법치주의에 전혀 맞지 않는 違法(위법), 違憲(위헌)의 탄핵임을 깨닫고 모두 일어나 헌법재판소에, 국회에, 언론에 강력히 항의하여 탄핵을 기각시키고 박근혜 대통령에게 당초 약속한 대로 5년의 임기를 마치고 퇴임할 수 있도록 함으로써 무너진 法治(법치)질서, 헌법질서를 회복시켜 정상적인 국가, 법치사회로 되돌아갈 수 있기를 기원한다.

이 책을 쓰도록 항상 나를 보살펴준 나의 사랑하는 아내 한연금에게 나의 생애 첫 책을 바친다. 그리고, 항상 같이 교정을 보며 격려해준 나의 친구 정귀영 박사, 염인섭 화백, 차학성 동지, 메나골의 우정 정학철 兄(형), 그리고 모든 자료를 다 챙겨준 나의 영원한 제자 박두수 君(군), 그밖에 나의 글을 읽고 격려를 해주신 여러분들께 감사드린다. 물론, 이 책을 쓰도록 제안하시고, 끝내 출판까지 다 맡아 해주신 조갑제 선생께는 무엇이라 더 말할 수 없이 감사드린다. 이 추운 겨울날에 나라를 위해 태극기를 들고 거리에 나가 탄핵반대를 외치는 국민 여러분들께도 건강과 神(신)의 가호를 빈다.

끝으로, 친구 하나 잘못 두신 죄로 그 깨끗한 이름을 잃으시고 탄핵소추까지 당하는 수모를 겪었으나 끝까지 의연하게 대통령의 품위를 잃지 않고 대한민국의 헌법을 수호하신 박근혜 대통령께 깊은 존경과 사랑을 드린다.
