Even so, the absence of any such things as government or civil order is so greatly to the detriment of human beings that, Locke believed, individuals came together voluntarily to create society. As with Hobbes, the social contract is seen as being not between government and the governed but between free men. Unlike Hobbes, however, Locke sees the governed as retaining their individual rights even after government has been set up. Sovereignty ultimately remains with the people. The securing of their rights ―the protection of the life, liberty, and property of all―is the sole legitimate purpose of government. If a government begins to abuse those rights (i.e. becomes tyrannical) or ceases to defend them effectively (i.e. becomes ineffectual) the governed retain a moral right―after seeking redress through normal procedures and failing to obtain it―to overthrow the government and replace it with one that does the job properly. This explains, incidentally, Locke's role in the Glorious Revolution of 1688.

Locke believed that what gives us the right to our property is, first of all, the labor we put into it; and then following on from that, our freedom to do what we like with our own. If I work to produce something, in doing so do no harm to anyone else, then I have a right to the fruits of my labor. If someone seizes it from me he is, literally, stealing my labor. Given, then, that I have this right to it, I can dispose of it as I wish: I can give it to someone else if I so choose, or sell it to a willing buyer. Thus a society develops that is based on voluntary transactions entered into independently of government. 그렇더라도 정부나 시민사회(order: 질서, 사회, 계급)와 같은 사물의 不在(부재)는 인간에게 너무 큰 손해(detriment: 상해, 손실)를 주었기 때문에 개인들은 자발적으로 사회를 창조하게 되었다고 Locke는 믿었다. Hobbes의 경우에서처럼, 사회계약은 정부와 피치자간에 존재하는 것이 아니고 자유인들 사이에 존재하는 것으로 간주되었다. 그러나 Hobbes와 달리 Locke는 심지어 정부가 세워진 후에도 피치자는 그들의 개인의 권리를 계속 유지하는 것으로 간주한다. 주권은 궁극적으로 국민에게 있다. 국민의 권리를 보장하는 것이―모든 국민의 생명과 자유와 재산의 보호―정부의 유일한 합법적 목적이다. 만약 정부가 그러한 권리를 남용하면 (즉 독재적이 되면) 혹은 그 권리를 효과적으로 방어하는 것을 중단하면 (즉 비능률적이 되면)―정상적인 절차를 통해서 교정을 추구하고 그 교정을 획득하지 못한 후에―피치자는 그 정부를 전복하고 그 일을 적절하게 하는 정부와 교체할 수 있는 도덕적 권리를 가진다. 이것이 우연히도 1688년 명예혁명에서 Locke의 역할을 설명해 준다.

국민의 자유와 생명과 재산의 보호가 정부의 유일한 목적이다. 만약 정부가 이러한 국민의 권리를 보호하는 것을 태만히 하거나 또는 중단하면 국민은 그러한 정부를 전복하거나 교체할 권리를 가지고 있다. 영국의 명예혁명이나 미국의 독립혁명도 이러한 권리를 근거로 하여 일어난 것이다.

국민의 재산권은 신성불가침의 권리이다. 재산의 형성이나 유지는 국민의 노력의 결과이기 때문이다. 그것은 개개인의 노력의 열매이다. 그래서 누군가가 그것을 빼앗아 간다면 그것을 도둑질이고 강탈이다. 개인은 법만 위반하지 않으면 재산을 활용할 수 있는 자유와 권리를 가지며 정부는 이에 개입하거나 저지할 권리가 없다. 재산권이 확보되어야 정부로부터 독립할 수 있다. 재산권은 자유민주주의의 핵심적 권리이기 때문이다.
