앵커:유엔의 토마스 오헤아 퀸타나 북한인권특별보고관은 이른바 ‘대북전단금지법’과 관련해 최근 한국 정부가 유엔 측의 문제 제기에 나름 해명했다는 점은 인정할 만하지만 여전히 그 규정이 국제인권규약 등 국제적 기준에 맞지 않아 재검토가 필요하다고 지적했습니다. 한덕인 기자가 퀸타나 특별보고관과 전화로 대화를 나눠봤습니다.

기자:먼저 한국 정부가 보낸 관련 서한에서 논란이 된 부분에 대한 견해를 듣고 싶습니다. 한국 정부는 서한에서 대북전단금지법이 “표현의 수단을 최소한으로 제한하는 것일 뿐 표현의 자유와 관련된 본질적인 내용을 제한하는 것은 아니”라는 해명을 내놓았는데요. 일각에선 수단을 제한하면서 내용을 제한한다는 한국 측 주장은 비논리적이라는 지적이 제기되고 있는데요.

퀸타나 보고관:이러한 한국 정부의 발언은 잘못된 것입니다. 국제인권규약에 의해 보장되는 표현의 자유는 정보의 전파 방식도 보호된다고 말하고 있습니다. 따라서 표현이 뒷받침되는 방식도 인권법에 보호되고 있다는 것이고, 이러한 한국 정부의 발언을 옳지 않습니다. (“These statements from the South Korean government are wrong, which is that the right of freedom of expression as it is provided by the universal declaration of human rights, says that the method of disseminating information is also protected. So the method, the way that the expression is being backed, is also protected by the human rights law. So these statement from the government is not correct.”)

기자:한국 정부가 보낸 해명 서한에 대한 첫 인상과 평가를 부탁드립니다.

퀸타나 보고관:서한에 대한 제 첫 인상은 일단 한국 정부는 앞서 제가 대북전단금지법에 관해 표명한 문제 제기에 과거에 해명했던 것과 다른 어떤 새로운 주장이나 명분도 내세우지 못했다는 것입니다. 다만 한국 정부가 이에 관한 문제 제기에 해명하려는 노력은 인상적입니다. 저도 일단 그 부분에 대해선 평가하고 싶습니다. 한국 정부 스스로가 대북전단금지법의 취지를 국제사회에 설명하고 정당화하는 노력은 분명 중요합니다. (“Okay, my initial reaction would be that the South Korean government is not bringing any new argument or justification different from what they already said in the past after my express of concerns. What is important is that the government responded. That's something that I will emphasize. It's important that they tried to explain the anti-leaflet legislation, they are making an effort in trying to justify.”)

기자:그래서 이번 서한을 살펴보신 후 어떤 결론에 도달했나요?

퀸타나 보고관:물론 정부가 반응했다는 점은 중요합니다. 다만 그들의 반응을 살펴본 후 저는 새로운 정보가 없다는 결론에 도달했습니다. 그리고 유엔 북한인권특별보고관의 관점에서 대북전단금지법에 대한 평가는 여전히 변한 것이 없습니다. 물론 한국 정부의 관점에선 전단 살포 금지를 추진하는 데 합리적인 이유가 있을 수 있습니다. 하지만 현실은 해당 법이 규정하는 최대 3년의 징역형은 국제법상 허용되는 제재 체계를 벗어난다는 것이고, 심지어 2년형이라 하더라도 이는 적절한 수준의 처벌이 아닙니다. 물론 어떤 사람들은 이런 것들이 그다지 중요하다고 생각하지 않을 수 있습니다. 하지만 제가 앞서 여러 번 강조해 왔지만, 그것은 정부가 표현의 자유를 제한하기 위해 사용하는 도구들이 무엇인지 의미하기 때문에 매우 중요합니다. 그리고 한국 정부가 사용하려는 ‘대북전단금지법’이란 도구는 국제인권법 규정에 맞지 않는 내용을 여전히 담고 있습니다. (“But after taking a look of their response, I came to the conclusion that there is no new information. And the situation of the legislation continues to be the same from my point of view as the Human Rights Rapporteur. What it means is that, even though it seems to be some legitimate importance by the government to prohibit, specifically, the scattering of the leaflets, the reality is that the legislation provides for the sanctions system that is not allowed on the international law, meaning that the punishment for up to 3 years, even if it's 2 years, the punishment is not proportional. And I have stressed many times. For some people may not be deemed too important, but it is very important because it means that what are the instruments that the government is using to limit freedom of expression. And this instrument- this disproportioned punishment is not in accordance with the human rights law.”)

기자:그렇다면 대북전단금지법에 대한 재검토가 필요하다는 기존 입장에는 여전히 변함이 없다는 말인가요?

퀸타나 보고관:변하지 않았습니다. 재검토가 필요하다고 생각하며, 최소 방금 우리가 얘기한 (처벌 규정) 부분에 관해선 분명 다시 짚어 볼 필요가 있다고 봅니다. (“It has not changed. I think there is a need to review at least on the part of the legislation we were talking about.”)

기자:대북전단금지법에 관해 추가로 하고 싶은 말씀은?

퀸타나 보고관:이건 앞서 한국 통일부 관계자들과 만난 자리에서도 얘기를 나눈 적이 있는 사안입니다. 그것은 비록 한국 정부가 전단 살포 행위를 제한하기 위한 하나의 도구(대북전단금지법)를 지녔다 하더라도 국경 쪽으로 전단을 살포하는 개인이나 단체들에 책임을 떠넘기거나 그들의 탓을 해선 안 된다는 겁니다. 또 이들이 북한 당국의 반응에 따른 피해자가 되어서도 안 됩니다. 더더욱 북한은 자신들만의 일방적인 주장을 앞세우며 해당 문제에 관한 진지한 논의에 임하지 않고 있습니다. 따라서 전단 살포에 연루된 개인 및 단체들에 휴전상황이나 안보문제를 앞세워 책임을 묻는 것은 옳지 않습니다. 특히 안보문제는 한반도에서 ‘대북전단금지법’을 넘어서는 훨씬 더 광범위한 사안입니다. 한반도의 군사훈련도 북한이 예민하게 반응하는 사인 중 하나이고요. 따라서 안보문제와 관련해서는 전단뿐만 아니라 여러 가지 다양한 측면이 있습니다. 그러므로 이 개인들은 북한 당국의 잘못에 대한 비난을 받아서는 안 되며, 훨씬 더 광범위한 안보상황에 대한 것은 그들의 책임이 아닙니다. (“On the other account, if I say one more thing which may be important. It is something that I also discussed when I met with officials from the Ministry of Unification. Which is that those organizations and those individuals who basically do this thing of scattering of leaflets towards the border, even if the government has a device to limit at some point of their activity, they should not be blamed for the conduct of the North Korean government. Because the bottom line is that the North Korean government reacts completely disproportionately to discussing about leaflets. Therefore, these people should not be blamed for; not even for the situation of the ceasefire and the situation of security concerns that are constantly raised. Because the problem of security on the Korean Peninsula is much broader. For example, the military exercises of the South Korean government… So, there are many different aspects regarding the security. So, these individuals should not be blamed for the wrongs of the North Korean government, and for much broader security situation that is not their responsibility.”)
