The National Assembly votes this afternoon on whether to ratify a bill seeking to impeach the president. According to the news media, almost all opposition lawmakers and a considerable number ruling party lawmakers apparently voiced their support.
 
The news media and opposition lawmakers initially demanded Park's resignation by blaming her for overlooking Choi's influence-peddling activities and meddling in state affairs. Then they claimed that Park must be impeached after the president refused to cave in to their initial demands. Impeachment must be backed by a violation of the Constitution or an illegal act committed by the leader facing impeachment.

From what I have seen, the fundamental reason being cited for impeachment is absurd. Opposition party lawmakers claim that Park was an accomplice to the acts of corruption Choi allegedly committed. They have reached the foregone conclusion that the scandal involves the president, and not her confidante, by claiming that Park is guilty of creating the Mir and K-Sports foundations that received donations from major business groups allegedly under pressure. And the news media and opposition lawmakers have pinned rumors about the president's whereabouts during the initial hours of the Sewol ferry disaster on to the corruption scandal resulting in a ludicrous violation of the Constitution that is unheard of in the modern world not to mention codes of criminal law.
 
The rumors being spread about the president's activities during the initial hours of the Sewol ferry sinking are mind-boggling to say the least. For a woman, having her hair done is as much a part of daily routine as eating and dressing. Did opposition party lawmakers, including one presidential contender who goes by the surname Moon, stand still as the ferry sank, refusing to get dressed, going without food or refraining from stopping by the bathroom? Should Park have been dressed in rags, covered her face with ashes and started fasting in order to escape criticism? This is simply embarrassing. Is this the level of maturity we can expect from the National Assembly, news media and the public in this day and age?

A look at the interim results of the investigation by prosecutors and impeachment motion shows strong suggestions accusing Park of being Choi's accomplice.  Legally speaking, in order to corroborate complicity in a crime, prior consultation must have taken place. That means prosecutors and lawmakers need to present concrete evidence that Park conspired with Choi to split the proceeds of money received from business conglomerates in the form of donations or that Park and Choi conspired to pressure big businesses into making the massive donations. But no such evidence has been presented so far.
 
Until now, many past presidents, lawmakers and countless numbers of media company heads formed non-profit organizations that received donations from big business conglomerates. Yet nobody has been held accountable until now. Even Hillary Clinton created her own charitable organization that received donations from businesses.
 
Such acts may not always be viewed positively by the public. But the legality of such acts is another matter. Blaming Park's acts as being criminal is not fair from a legal standpoint and goes against the rule of law. It is extremely disappointing that the news media of this country, opposition lawmakers and the public reached a foregone conclusion of the president's wrongdoing even before her innocence or guilt has been proven by a court of law.
 
Former president Roh Moo-hyun also faced impeachment 12 years ago, but the Constitutional Court dismissed the case. An impeachment proceeding is a form of legal process that the Constitutional Court rules either in favor of or against, while the National Assembly submits the indictment. The president's official powers are suspended temporarily after lawmakers ratify an impeachment bill, but her status is still guaranteed by law. The Constitutional Court makes the decision whether to impeach the president or not. And six out of the nine Constitutional Court justices must agree in order for a president to be impeached. It is not an easy process to say the least.

Opposition lawmakers and the news media are fooling the public into thinking that passing an impeachment motion that temporarily suspends the president's powers automatically binds the Constitutional Court to approve the bill. Opposition lawmakers and the news media will attempt to wield their influence on the Constitutional Court and parliamentary inspection into the influence-peddling and corruption scandal. It appears that they are using the impeachment bill as a tool to bring the president down. This is simply a vicious and barbaric act.
 
I hesitate to say that Park is the least corrupt leader we have seen in our country. No past president has faced impeachment by lawmakers for alleged acts of corruption committed by their family members or friends. There is no exact monetary figure gauging the alleged acts of corruption and it will probably amount to a few hundred million won at the most. Yet what country other than Korea would have the gall to pursue steps to impeach the president by accusing her of being an accomplice to an alleged crime?

We are witnessing events similar to ones that took place during China's Cultural Revolution during the 1960s when Mao Zedong, then chairman of the Communist Party of China, alleged that bourgeois elements had infiltrated the government and society at large, scheming to bring back capitalism. It led to a mass purge of senior officials, most notably Liu Shaoqi, then China's president, who was dragged before the masses, presented before a kangaroo court and punished. Park is being forced to go through he unimaginable humiliation and torture Liu was subjected to.
 
How will the international community perceive our nation? They will scoff at us for moving to impeach our leader and stripping her of her powers to get back at her for refusing to bow to uncorroborated demands to step down. That is not all. Forces that are hell-bent on protesting to pressure the president to step down regardless of the Constitutional Court's ruling, the news media reminiscent of a posse and intellectuals and legal experts who siding with such factions will also become the targets of ridicule. And the public, which stood idly by as their president was subject to a violent lynching in the court of public opinion will also be the targets of scorn.

너무나 황당한 탄핵사유

法理(법리) 관계가 명확하게 규명되기 전에 대통령에게 죄가 있다고 단정한 이 나라의 언론과 야당, 이에 보조를 맞추는 일부 시민들이 참으로 실망스럽다!

박근혜 대통령 탄핵소추안 표결이 오늘 오후 국회에서 실시된다. 언론에 따르면, 야당은 거의 전원, 여기에 상당수 여당 의원들까지 찬성의사를 밝혔다고 한다.
  
  처음 언론과 야당은 최순실의 비리·부정·국정농단을 이유로 대통령의 下野(하야)를 요구하다가 대통령이 하야를 사실상 거부하자 탄핵을 주장했다. 탄핵은 被(피)탄핵자 본인의 헌법위반이나 법률위반을 사유로 한다. 
  
  필자가 보기에 탄핵사유부터 다소 황당하다. 야당 의원들은 朴 대통령이 최순실과 사실상 공동으로 비리를 저질렀다고 주장한다. 미르재단을 만들어 재벌들로부터 기부를 강요하는 등의 죄를 저질렀기 때문에 측근비리가 아니라 대통령 자신의 비리라고 단정한 것이다. 이에 덧붙여 세월호 사건까지 결부시키는 등 세계 어느 나라 《刑事法典(형사법전)》에도 없는, 조선왕조 사극에나 나올 법한 황당한 違法(위법) 사유를 만들어냈다. 
  
  세월호 이야기는 너무 황당하다. 여자가 머리 고치는 건 여자가 밥 먹고, 옷 입는 거와 같은 생활의 일부다. 야당의 유력 대권주자 文 모 씨를 포함한 야당 의원들은 세월호 사건 때 옷도 안 입고, 밥도 안 먹고, 변도 안 보았나? 부모가 죽은 불효자처럼 소복하고, 금식하고, 세수도 하지 말았어야 죄를 면하나? 정말 부끄럽다. 이것이 21세기 대한민국 국회, 언론, 국민의 수준이란 말인가. 
  
  검찰 중간 수사발표와 탄핵소추안을 보면, 박근혜 대통령이 최순실과 共犯(공범)관계라는 취지의 기술이 있다. 법률상 공범죄가 성립하려면 공범자간에 범죄에 대한 故意(고의)와 事前(사전)모의가 있어야 한다. 그 얘기는 朴 대통령이 최순실과 함께 짜고 기부를 빙자하여 기업체로부터 돈을 뜯어 둘이 나눠 먹었다든지 아니면 朴 대통령이 최순실과 짜고 기업체에 기부를 강요했다는 등 共犯 관계를 입증할 수 있는 명백한 증거가 있어야 한다. 그러나 현재까지 이 같은 증거는 드러난 바가 없다.
  
  지금까지 역대 대통령과 많은 국회의원, 언론사 社主(사주)들이 재직 중에 각종 재단을 만들어 재벌들의 기부를 받았다. 어느 누구도 이것으로 책임을 추궁당한 적이 없다. 심지어 미국의 힐러리 클린턴도 자선 단체를 만들고 기업체의 기부를 받았다.
  
  그것이 일반 국민들에게 반드시 좋게만 보이는 건 아니다. 그렇다고 그것이 범죄가 되느냐, 되지 않느냐는 별개의 문제다. 유독 박근혜 대통령에게 가혹하게 죄라고 우기는 건 진정한 法治(법치)주의가 아니다. 法理(법리) 관계가 명확하게 규명되기 전에 대통령에게 죄가 있다고 단정한 이 나라의 언론과 야당, 이에 보조를 맞추는 일부 시민들이 참으로 실망스럽다.
  
  12년 전, 노무현 대통령이 국회에서 탄핵소추 받았으나 헌법재판소에서 기각된 사례가 있다. 탄핵은 일종의 사법절차이므로 결정은 헌법재판소가 하고 국회는 단지 起訴(기소)만 하는 것이다. 국회가 탄핵소추하면 대통령의 직무가 일시 정지되는 것일 뿐, 대통령의 지위는 존속된다. 탄핵결정은 헌법재판소가 한다. 정원 9명의 재판관 중 6명이 찬성해야 탄핵이 되므로 탄핵이 그리 쉬운 건 아니다. 
  
  야당과 언론은, 국회가 탄핵 결정 권한이 아닌 대통령의 권한을 몇 달 정지시킬 수 있는 권한을 가지고, 마치 탄핵소추를 가결시키면 헌법재판소는 무조건 이를 승인해야 하는 것처럼 국민을 誤導(오도)하고 있다. 이들은 이 사건과 관련해 차후에 있을 각종 재판(탄핵 가결에 따른 헌재 審理 등), 국정조사 중에도 지속적으로 압박을 가해 영향력을 행사하려 들 것이다. 결국 대통령 下野를 끌어내는 수단으로 탄핵소추를 이용하는 것으로 보인다. 참으로 잔인한 야만적 발상이다.
  
  단언컨대 비리로 말하면 박근혜 대통령은 역대 어느 대통령보다 자유롭다는 게 내 생각이다. 과거 대통령 一家가 저지른 비리로 대통령에게 비리와 부정의 共犯(공범)이라는 죄명을 씌워 국회가 탄핵소추를 한 예는 없다. 비리의 정확한 액수도 알 수 없고, 기껏해야 몇십 억이 안 넘는 액수라고 본다. 그럼에도 제 나라 대통령에게 공범이라는 죄명을 씌워 국회가 대통령을 탄핵소추 하는 나라가 세계에 또 있을까?
  
  1960년대 중국에서 모택동의 지시를 받은 江靑(강청) 등 소위 4인방과 홍위병들이 국가주석 劉少奇(유소기)에게 고깔을 씌우고 부르조아 反動(반동)분자라는 황당한 죄명을 씌워 인민재판으로 끌어낸 것과 다를 바 없는 짓이다. 인간으로서 도저히 견딜 수 없는 수모를 주었던 과거 중국의 사례와 거의 같다는 의미다.
  
  국제사회는 우리나라를 어떻게 볼까? 제 나라 대통령을 증거도 없이 下野(하야) 시키려다 안 되니까 그 보복으로 탄핵소추를 해 직무정지 시켰다고 비웃을 것이다. 그 뿐인가? 가결되든 부결되든 헌법재판소에 달려가 시위를 벌이겠다고 협박하는 세력, 그리고 이를 여과 없이 보도하며 동조하는 언론, 이에 보조를 맞추는 법조인·지식인들에게도 嘲笑(조소)를 보낼 것이다. 무엇보다 자기 나라 대통령에게 가해지는 야만적인 린치를 뒷짐 지고 구경하며 朴 대통령에게 한탄과 비난만 쏟아내는 국민들에게도 경멸이 쏟아질지 모른다.
